A federal judge declared that a 2021 law restricting state investments in companies boycotting the fossil fuel industry was unconstitutional, calling it “facially over broad”, citing First and Fourteenth Amendment violations.
The original legislation was passed by pro-fossil fuel legislators as a way of discouraging fossil fuel divestment at a time of increased concern by investors of climate-related financial risk.
